You can apply for registration of your child as a British Citizen using application form MN1 as soon as one of the parents has either obtained ILR or has become a British Citizen if your child was born in the UK when neither parent of the child was settled or British Citizen. An application for registration of a child as a British Citizen under Section 1(3) of the British Nationality Act 1981 can only be made while the child is still a minor, i.e. under 18.

Legal Framework for Registering a Child as a British Citizen under Section 1(3) of BNA 1981

The application to register the child as a British Citizen in such circumstances is made under Section 1(3) of the British Nationality Act 1981, which provides that:

"A person born in the United Kingdom after commencement who is not a British citizen by virtue of subsection (1) or (2) shall be entitled to be registered as a British citizen if, while he is a minor—

(a) his father or mother becomes a British citizen or becomes settled in the United Kingdom; and

(b) an application is made for his registration as a British citizen."
