Requirements For Extension Of Leave To Remain As A Young Adult
A person applying for extension of stay as a young adult should meet the following requirements of the Immigration Rules as set out in Appendix Private Life:
Valid Application
The applicant must submit a valid application for extension of leave to remain as a young adult in accordance with requirements for a valid application as set out in Appendix Private Life of the Immigration Rules.
Suitability Requirements
The applicant's application for extension of leave to remain as a young adult must not fall refusal on suitability grounds as set out in the Immigration Rules.
Residence Requirement
The applicant would have met the residence of living at least half of the life in the UK and being aged 18 or over and under 25 at the date of initial application and does not need to meet the same requirement at the time of extension application. This requirement will be automatically met due to initial successful application which was granted on the basis of being 18 or over and under 25 and living at least half of the life in the UK at the time of the initial application.
Period and Conditions Of Grant
If the applicant is a young adult who has spent half their life in the UK at the date of application (or was previously granted as a young adult on the private life route), they will be granted permission to stay for either:
- 30 months, where the applicant has applied for a period of 30 months; or
- 60 months, where the applicant has applied for a period of 60 months.
Where a person is seeking to extend their permission to stay, any remaining period of permission at the date of application will be added to their next grant of permission, up to a maximum of 28 days.
The grant of permission will be subject to the following conditions:
- work (including self-employment and voluntary work) permitted; and
- study is permitted, subject to the ATAS condition in Appendix ATAS; and
- if the decision maker is satisfied that:
- the applicant is destitute, as defined in section 95 of the Immigration and Asylum Act 1999, or is at risk of imminent destitution; or
- there are reasons relating to the welfare of a relevant child which outweigh the considerations for imposing or maintaining the condition (treating the best interests of the relevant child as a primary consideration), the applicant will not be subject to a condition of no access to public funds. If the decision maker is not so satisfied, the applicant will be subject to a condition of no access to public funds.
